Privacy and Cookie Statement

This privacy and cookie statement was most recently amended on 2 September 2020.

Giarte Media Group B.V. (hereinafter: Giarte) is a research and consultancy agency for IT experiences. We make actionable what really counts in business IT: customer satisfaction, user experience and trust. To make this possible, we process personal data. Your privacy is of paramount importance to Giarte. For that reason, we comply with relevant privacy laws and regulations, including the General Data Protection Regulation (GDPR).

Summarised privacy and cookie statement

When processing personal data, we comply with the requirements set by privacy legislation. This means that we:

  • Clearly set out our purposes before processing your personal data, by means of this privacy and cookie statement.
  • Store as few personal data as possible and only the data necessary for our purposes.
  • Ask explicit consent for processing your personal data, if consent is required.
  • Take the necessary security measures to protect your personal data. We also impose these
    obligations on parties that process personal data on our behalf.
  • Respect your rights, such as the right to access, the right to rectification or the right to
    erasure of your personal data processed by us.

Purposes for use of your personal data

In this privacy and cookie statement we explain what we do at Giarte with information that we learn about you. When you visit our website www​.gia​rte​.com or when you use our services, we obtain different kinds of personal data about you. For each purpose, we indicate what data about you we obtain, for which purpose we process these data, and how long we keep these data. Contact

When you contact us using the contact form, by email, by telephone or in any other way, you accept our offer for you to contact us (performance of the contract).
We process the following personal data for this purpose:

  • First and last name
  • Company name
  • Email address
  • Telephone number
  • Any information you provide yourself as content of a message

We keep this information for as long as is needed for this contact or up to 6 months after we last had contact with you, because we want to be certain that we have handled your question or complaint properly.

Provision of our services

Giarte offers three unique services to document experiential knowledge and experiences about the provision of IT services in business environments: XLA (Xperience Level Agreement), Amaze (measurement framework) and Outsourcing Performance (OP – sourcing benchmark). When you use one of these services, we process your personal data. The purpose is to be able to perform the contract we conclude with you (performance of the contract).

We process the following personal data for this purpose:

  • Name or company name
  • Your address details or those of your company
  • Your email address or that of your company
  • Your telephone number or that of your company
  • Name and title of the contact person
  • Invoice data
  • Payment details

We keep this information during the contract period and for 2 years afterwards. Some data are kept longer if we have a statutory obligation to do so (for instance because of the retention obligation under tax legislation).
Placing and processing an order
You can order Giarte publications on our website. When you place an order with us, you leave certain data behind. We need these data to handle the order and to perform the contract we conclude with you (performance of the contract).

We process the following personal data for this purpose:

  • Company name
  • Title
  • Initials
  • Delivery address
  • Telephone number
  • Email address
  • Any information you provide yourself as content of a message

We keep these data for 2 years after you have placed the order.

Job applications

If you have responded to one of our job openings or have sent an unsolicited application, we process your personal data to handle your application, and to make preparations for possible conclusion of an employment contract (performance of the contract).

We process the following personal data for this purpose:

  • Name and address
  • Contact details (email address and telephone number)
  • Curriculum Vitae
  • Motivation letter
  • Salary indication
  • References
  • Any other information you send along with your application

We keep your application details up to 6 weeks after the position has been filled. We keep these data so that we can contact you in case the position becomes available again within the trial period. If we cannot offer you a position at the moment, we can — with your consent — keep the application data for another year. You can withdraw your consent at any time by sending us an email. If you end up working for us, we keep your application details in your personnel file. This file is kept for as long as necessary; your application details are kept for up to 2 years after commencement of employment.

Anonymisation

We can anonymise the personal data we obtain through the use of our services. This means that the personal data originally obtained by us have been made anonymous in such a way that the data subject can no longer be identified on the basis of these data. As a result, the data are no longer personal data and there are, therefore, no privacy risks associated with them.

We have a legitimate interest in anonymising data, as these anonymised data enable us to improve our services and perform statistical research.

Social media buttons

On our website we use social media buttons that forward you to
the social media platforms. This will give you the option to follow us and share content within the network. You will also see advertisements on your social media page. The buttons work by means of small pieces of code from the social media networks. If you would like to know what the

These social media companies are headquartered in the United States. We are aware of the ruling of the EU Court of Justice of 16 July 2020 (Schrems II case). We are currently studying how best to overcome this. Privacy is of paramount importance to us and we try and do everything to find an appropriate solution. Once we have found an appropriate solution, we will inform you by means of this privacy statement. Sharing your personal data with third parties

Giarte only shares your personal data with third parties if this is allowed under present legislation. We may provide your personal data to third parties because:

  • We have engaged them to process certain data.
  • It is necessary to perform the contract concluded with you.
  • You give your consent.
  • We have a legitimate interest.
  • We are legally obliged to do so (for instance if required by the police in case of suspicion of
    a criminal offence).

The parties that process personal details on our or your instructions are:

  • IT suppliers and service providers.
  • Cookie service providers.
  • Payment service providers.
  • Partners.
  • Consultants.
  • Marketing companies.

To be able to provide our services, Giarte may provide your personal data to parties outside the European Economic Area (EEA). Giarte only does this if there is an appropriate level of protection for the processing of personal data. This means, for instance, that we use a model agreement from the European Commission or make arrangements for handling personal data.

Cookies

On our websites, we use our own cookies and those of third parties. Cookies are small information files that can be automatically stored on or read from the visitor’s device (such as a PC, tablet or smartphone) during a visit to the website. This is done by means of the web browser on the device. Giarte uses cookies to:

  • Enable functionalities of the website (technical and functional cookies).
  • Analyse the use of the website and, on the basis of that analysis, improve
    the user experience of the website (analytical cookies).
  • Be able to show personalised advertisements (marketing cookies).

These cookies collect the following data about you:

  • Website and clicking behaviour.
  • Referrer URL.

Your privacy rights

You have the following rights:

  • Right to access: You have the right to access the personal data we process on you.
  • Right to rectification: You have the right to rectify or supplement the personal data about
    you that we process if these are incorrect or incomplete.
  • Right to object: You have the right to object to the processing of your personal data and to
    direct marketing.
  • Right of removal: You can ask us to remove your personal data.
  • Right to withdraw your consent: If you have given us consent to process personal data, you can withdraw this consent at any time.
  • Right to data portability: You have the right to have the personal data we process on you
    transferred to a third party, if this is technically possible.
  • Right to restriction on processing: In some cases, you can ask us to restrict the processing
    of your personal data (temporarily or permanently).

If you make such a request, we may ask you for identification. To this end, we will request data to make sure that you are the right person to whom the personal data belong.

We will, in principle, honour your request within one month. However, this term may be extended by two months for reasons related to specific privacy rights or the complexity of the request. We will notify you in good time if we extend this period.

We will handle every question and complaint internally and communicate this with you. If you believe we are not helping you in the right way, you have the right to file a complaint with the supervisory authority. This is the Dutch Data Protection Authority.
